DANGEROUS DOG ACT SECTION 3
Many dog owners are unaware that the Dangerous Dog Act concerns their dog as most people think it only refers to banned breeds such as Pit Bull type. This is simply not true as the law covers all breeds.
Section 3 makes it a CRIMINAL OFFENCE for any dog of any breed from Chihuahua to Great Dane to be dangerously out of control in a public place and the offence is committed both whoever was in charge of the dog and also the owner even if the owner was not there at the time.
The law defines “dangerously out of control” as "any occasion on which there are grounds for reasonable apprehension that a dog will injure any person". In plain English this means that the dog does not actually have to bite someone to be called out of control. If the person thinks the dog may injure them and is frightened then this is breaking the law. So you may have a dangerous dog without realising it.
DANGEROUS DOG ACT SECTION 3 CHANGED IN 2014
In 2014 the law was amended and now includes private property which is both the front and back garden and the home. The law was changed so that Postmen or anybody delivering or calling to their home is protected. Even now over 40 Postmen are bitten every week.
This puts a huge responsibility on dog owners as they may have a dangerous dog in the eyes of the law and it applies to anybody coming into your garden or your home. This could be a neighbour or a child and the only possible exception is if it’s a burglar or trespasser but this only applies to your home not the garden.
